GrowHempColorado.com was created in 2014 with the sole purpose to provide a online source of information on Hemp Farming, laws, rules and regulations for the state of Colorado. Since then we have expanded to many more free services and will be adding a members only section this coming year.
With so much interest in hemp, our web stats hit slightly under 500K hits in November 2014.

GHC Hemp Food/Concentrate Questions to State Health Department - September/October 2015
On or around the end of September 2015, a detailed letter by GHC with very specific questions were provided to Boulder County Health Department for official response. This information was forwarded to CDPHE, to a division called LAP, which was then forwarded to CDPHE Manufacture/Wholesale Division, which is believed to have also escalated to discussions with FDA for the answers that were provided back to GHC on 10.9.15.
CDPHE Response to Questions
1. Can hemp plant extraction be done in a licensed commercial kitchen, provided it follows permitted guidelines for this process?
Yes, if it follows the permitted guidelines as described in the letter you provided.
2.Can hemp plant extractions/concentrate be used in a commercial kitchen to mix in or add to other products?
Yes, the use of hemp extracts as a food ingredient is not considered an adulterant. We would treat this like any other produce/herb type of ingredient if the product is sold as a food at retail.
3.Are hemp foods and products regulated under the same guidelines as any food?
Yes, since hemp extracts (produced under the permitted guidelines) are simply considered a food additive they are treated the same as any other food product.

6.21.16 - CDPHE “retraction email” sent to multiple parties (GHC was forwarded from multiple parties CC’d) with new/vague statement regarding hemp.
This email was sent by the LAP Division (via the Manufacturing/Wholesale Division) of CDHPE to multiple parties and stated the following:
On June 28,2016 "Denial" letter from CDPHE to Floras Bake Shop.
On June 28,2016 GHC was forwarded the "Denial" letter from CDPHE to Floras Bake Shop regarding the submitted & paid for Wholesale /Manufacturing License.
Meeting with NHA lobbist Samatha Walsh, Attorney Robert Hoban, CDPHE, CDA and Governors Office
Discussion of issue of change of police and new position discussed. Both NHA and Robert Hoban issued "update letters" posted on the web and in newsletters - can be found on left side of screen.
July 20, 2016 - GHC Emergency Hemp Industry Meeting
In a nut shell: a time line of events and facts were presented in regards to CDPHE new position on Hemp in food, which includes all parts of the plants (ie. CBD) as adulterated (aka illegal) ingredients with the exception of hemp pressed seed oil or other bi products from “sterilized” hemp seed (both domestically grown or imported are acceptable).
CDPHE Changes Made to Wholessale Manufacture License Form
Overnight, with zero notice or input from Industry as promised by CDPHE, changes were made to the State Wholesale/Manufacture license
The application from CDPHE now asks if applicants are using "Cannabis" or "Hemp". Not only were these changes unexpected but now legally inaccurate. The word cannabis here in Colorado incorporates both Hemp and Marijuana with out separation.

8.01.2016 - FDA Post New Updates on CBD
FDA very quietly updates their Q&A page, specifically section on CBD.
It has been understood by the Hemp Industry that certain claims can not be made due to GW Pharms use of FEDs patent on CBD, update included food and anything human consumable with CBD to be prohibited also.

DEA rejects marijuana’s medical use, keeping status Schedule I
"DEA denied the rescheduling, citing it has a high potential for abuse, no currently accepted medical use and it lacks accepted safety use under medical supervision, according to the filings."

Federal Government has changed their position on the interpretation of the Industrial Hemp definition.
Original Farm Bill 2014 Definition:
.—The term ‘‘industrial hemp’’ means the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis
The term “industrial hemp” includes the plant Cannabis sativa L. and any part or derivative of such plant, including seeds of such plant, whether growing or not, that is used exclusively for industrial purposes (fiber and seed) with a tetrahydrocannabinols
concentration of not more than 0.3 percent on a dry weight basis.
